What is the Howey Test?

Under the Howey Test, a transaction is considered to be a security if it meets the following four criteria:

1. Money is invested.
2. There is an expectation the investor will earn a profit.
3. The investment is in a common enterprise.
4. Profits are generated via the efforts of others.

Now that we are caught up on how SEC determines which crypto is a security or not, let us move forward and talk about the SEC chair interview video above, if you have watched and if you have not please check it out. I would say that the video above might have been edited as a lot of people claim it is, the same way some people claimed that SEC Chair Gary Gensler taught a crypto or blockchain course at MIT but it was not true because from my research the SEC Chair Gary Gensler was a professor of the Practice of Global Economics and Management at the MIT not crypto related but still I guess for the position which he is holds he should have done extensive research on crypto, blockchain and how they work, before SEC FUD attacks on crypto.

If the video is true and he cannot answer definitely what constitutes a security or not but he is using enforcement action to destabilize the cryptocurrency space then that is too bad, and he should be investigated because this video justifies and make it true that the investigation into Binance US must have been personal and he targeted CZ and his company for rejecting him in 2019 as an adviser to Binance.
